| Lewis Leiva gets retrial in rape conviction |

 BELIZE CITY, Wed. Mar. 3, 2010Court of Appeal orders retrial for Lewis Leiva convicted of raping an American tourist. The case of convicted rapist, Lewis Leiva, also known as “DJ Whiz” who was convicted in 2009 for raping a 20-year-old American tourist on vacation in Belize. Lewis, through his attorney Simeon Sampson, appealed his 12 year conviction, had it set aside, and a retrial was ordered. Leiva was ordered by the Court of Appeal judges to surrender his passport to the registrar and was granted $5,000 bail. By 12:00 noon, he was unable to meet bail and has been taken into custody until he can do so. His attorney, Simeon Sampson had argued one single ground of which he said that the trial judge erred in law when he misdirected the jury by suggesting to them in his sum up that if they find that the woman was intoxicated by any degree by law, she could not give consent to sex. |
