Antonio Gutierrez, a 36-year-old Orange Walk man, was accused of raping a 16-year-old girl in Northern Belize on August 12, 2011. In a trial which began on May 30, 2016, a jury found him guilty before Justice Herbert Lord on June 7, 2016. He was sentenced to eight years in prison. After being sentenced, he appealed the conviction at the Court of Appeals and on June 6, 2017, he was granted a retrial.

Gutierrez’s attorney appealed on three grounds and was successful in one of these arguments. As a result, his 8 year sentence was set aside and a retrial was ordered. He was offered bail in the sum of $4,500 and one surety of the same amount.

In the trial, Gutierrez’s defense was that he and the 16-year-old had consensual sexual intercourse. At his appeal, he was represented by attorney Anthony Sylvester.
