Nestor Gallindo, a 44-year-old taxi driver, was sentenced to 2 years in prison after he was found guilty sexually assaulting a 15-year-old minor who was a passenger in his taxi. He was found guilty on December 1, 2017 and sentenced on December 4, 2017. Gallindo appeared unrepresented before Senior Magistrate Aretha Ford where he pleaded not guilty.

In the first week of the trial, the minor told the court that Gallindo was hired by her relatives and upon picking her up, she noticed that he was consuming alcohol and as a result, she sat in the back seat of the vehicle. He drove off and at three different times during the ride, he touched her inappropriately on her leg. She said that he threatened her not to tell anyone including her mother or that he would ensure that her mother is fired from her job. She was initially afraid to tell her mother but upon arriving at her mother’s work, her mother noticed that she was crying and when she was asked why she was crying, she told her mother that Gallindo had touched and caressed her legs.

At his mitigation plea, Gallindo asked the court to consider the fact that he has children and a family to care for. He asked not to be sent to jail but Senior Magistrate Ford said that she believes he abuses the trust of his victims.
