Patrick PayneOn Friday, October 5th, Wood Pecker Street resident, 43-year-old Patrick Payne was found guilty of aggravated assault of an indecent nature upon a 16-year-old girl.

Payne appeared in the Belize City Magistrate’s Court #1 before the Chief Magistrate, Anne Marie Smith, who sentenced him to 3 years imprisonment. The trial began at 10 on Friday morning and Payne was found guilty following an in-camera testimony by the victim.

The girl told the court that on the night of August 12th, 2012, she was asleep in her room when she was sudden awakened by someone whom she felt was fondling her. When she opened her eyes, she realized that it was a man she knew well. She yelled out for help but by the time her mother came to her aid, her attacker, identified as Payne, had already ran out of her room and left the house. After being recognized, Payne was arrested and charged by the police.

In his defense, Payne who was unrepresented, maintained his innocence and from the dock, he told the court that the girl is telling lies about him because she likes to come home late and when her mother asked her where she was, she had to lie.

This is Payne’s second conviction for the offense of aggravated assault of an indecent nature. In 2004, he was convicted of this offense and sentence to 3 years imprisonment. He was also committed to the Supreme Court to stand trial for a rape in 2001 but there is no record of that rape case's outcome.
