Convicted of Aggravated Assault upon an 18-year-old woman Print E-mail

John SmithOn Friday, March 15th, 30-year-old John Smith, a laborer of Raccoon Street was convicted of one count of aggravated assault of an indecent nature upon an 18-year- old woman. Smith appeared before Chief Magistrate Anne Marie Smith where he was found guilty of the charge stemming from an incident which occurred on October 5th, 2012. Smith was remanded until Wednesday, March 20th.

In court, the young woman testified that she was at a christening when Smith took his two hands and caressed her breasts. Smith apparently was under the influence of alcohol when the incident occurred.
In his defense, Smith denied the allegations and said that on that night, at about 12:30 a.m., whilst at the christening, he stepped on the woman's toe and she began to insult him. He then turned around and pointed his finger at her and they got into an argument.

Under cross examination by the prosecutor, Sgt. Egbert Castillo, Smith, when it was suggested to him that it was possible that he touched the girl, said no because at the time he had food in one hand and drinks in the other. He was caught lying as earlier he had told the court that he had pointed his finger at the woman.
