Baptist told the court in mitigation that he has a common-law-wife and his mother to care for. He said he works construction jobs and that his mother is sickly. He added that he gives his mother some of his earnings and lives with the rest and now he has to pay court fines. Before imposing the two fines, Justice Gonzalez told Baptist, “You should be ashamed of yourself. You came here showing no remorse and no consideration for the child. She has been wrecked for life.”

The victim, who is now 15-years old had testified in the trial that Baptist Sr., first had sexual intercourse with her back in 2000, and then on three other occasions, he touched her inappropriately then on another occasion he fondled her and on the fourth occasion, he performed oral sex on her.

On conviction at the Supreme Court for carnal knowledge, Baptist was facing a minimum of 12 years imprisonment.
