Niccanor Fermin Convicted of Carnal Knowledge of 9-year-old Print E-mail

Niccanor FerminNiccanor Fermin, 41 years of age, has been convicted of six sexual offenses and will serve as much as 18 years in prison. On February 4th, 2010 a girl was accompanied by an adult when she visited the Family Violence Unit of the Belize Police Department and reported that Fermin had been having sex with her since July of 2004 when she was only 9 years old.


Fermin was arrested and charged with two counts of unlawful carnal knowledge and four counts of carnal knowledge. The girl is now 18 years old and on July 29th she took the stand before Justice Traodio Gonzalez and a jury of 9 and testified that on six separate occasions between 2004 and January 9, 2010 Fermin, who she knew well, had sexual intercourse and also performed oral and anal sex on her. She said the first incident occurred in 2004. She was only 9 years old when he took off her clothes and had sex with her though she said no. She said he did so again in 2006, 2007, 2008, 2009 and 2010. 

The child said that after the sixth time on January 9th, 2010 she asked Fermin to leave her alone because she was tired of it. Though Fermin told her that her mother would not believe her, she went ahead and reported the matter. The child was examined by a medical doctor who confirmed that she was carnally known and Fermin was arrested and charged with carnal knowledge. In his defense, Fermin said, “It wasn’t me.” His wife and daughter testified on his behalf saying that he was never alone with the child at any time; therefore, the incidents could not have happened.

On Wednesday, July 31st, a nine member jury of five men and four women deliberated for less than three hours and returned with a guilty verdict on all six counts of carnal knowledge. Justice Troadio Gonzalez listened to mitigation plea for Fermin on Friday, August 16th. Fermin’s wife, Debbie Suazo, his ex-girlfriend, Elizabeth Pratt, his niece, Jessica Beeks, and nephews, Glenroy Fermin and Consita Beeks, spoke on his behalf. They spoke about his responsibility to his children and said that he was not a bad man. Before sentencing Fermin, Justice Gonzalez said, “While I have heard the mitigation plea from all your witnesses, all of who are your relatives, two of them expressed that you have children who depend on you, but these were the things you should have considered before allowing yourself to be tempted.” Gonzalez then sentenced Fermin to 18 years each for the two counts of unlawful carnal knowledge and 7 years each for the four counts of carnal knowledge. The sentences are to run concurrently; therefore, he will serve a maximum of 18 years in prison.
