On Monday, June 23, charges of dangerous harm were withdrawn against Andy Cruz, 35 who was accused of injuring his 1 year old daughter. Cruz had been charged with dangerous harm upon the child on March 15, 2009.

In court, prosecutor Leeroy Banner entered a Nolle Prosequi after the child’s mother refused to testify in the trial which was set to start in the court room of Justice Troadio Gonzalez. After the Nolle Prosequi was entered Cruz was set free of the charge.

According to the prosecution, the testimony of the child’s mother was very important to the case but that was not possible since the child’s mother refused to testify since she and Cruz have gotten back together since the incident occurred in March 2009.

In 2009, the two were not together and Cruz was given parental visitation rights to have the child on weekends. It was during one of those visits that the incident occurred. At the time the child sustained a head injury and her mother was called by Cruz to the hospital.
